Labour Contractor Licence in Chennai: Contract Labour Registration & Licence

Planning to supply or engage contract labour in Tamil Nadu? A labour contractor licence is a labour-law compliance for eligible contractors supplying or employing contract workers. Depending on the framework that applies, it can involve contractor licensing, principal-employer registration, contract agreements, a security deposit, worker records and wage compliance.

The Occupational Safety, Health and Working Conditions (OSH) Code, 2020 came into force on 21 November 2025 and introduced a common-licence framework for contract labour. The Tamil Nadu Labour Department still publishes procedures and forms under the earlier Tamil Nadu framework, so both need to be understood.

At Aanoor Global, we support Chennai contractors and principal employers with applicability review, licence applications, documentation, Form V support and compliance planning. For 2026 applications: First confirm whether the OSH Code common-licence route applies to your arrangement. Use the older Tamil Nadu forms only where the authority specifically requires them. We review your worker count, establishment type and the current portal before filing.

Quick Answer: Who should apply?

Contractors supplying 50 or more contract workers, and establishments engaging that many contract workers, should review licensing under the OSH Code. Smaller arrangements may still fall under older state requirements, so check before deploying workers.

Earlier Framework vs OSH Code: Side-by-Side

What Is a Labour Contractor Licence?

A statutory licence for contractors who supply or engage contract labour in covered establishments. Contractors may provide workers for manufacturing, construction, facility management, security, housekeeping, maintenance, warehousing, logistics, loading and unloading, hospitality and other outsourced work. The framework regulates the engagement of contract workers and supports compliance on wages, working conditions and statutory responsibilities.

What is contract labour?

Workers engaged through a contractor rather than directly employed by the principal employer.

Example: A manufacturing company in Ambattur needs 40 housekeeping and maintenance workers. Instead of employing them directly, it signs an agreement with a manpower contractor: Principal Employer → Labour Contractor → Contract Workers. Each party has different responsibilities.

Labour Contractor vs Principal Employer

Particular Labour Contractor Principal Employer
Who they are Person or agency supplying or engaging workers Establishment where the workers are engaged
Filing Contractor licence Establishment / principal employer registration
Core duties Pay wages, handle PF/ESI/LWF, maintain records Issue certificate (Form V under the earlier rules), ensure specified safety and welfare facilities
Liability Primary employer of deployed workers Can be liable if the contractor fails to pay wages, as the Code provides
Key documents Licence application, contract, security deposit receipt Work order and service agreement
← Swipe Left & Right →

The exact obligations depend on the applicable law and the arrangement.

A private limited company can be either party:

As Contractor

It supplies workers to another establishment and should assess contractor licensing.

As Principal Employer

It engages workers through a contractor and has its own registration and compliance duties.

These are different situations and should not be confused.

Who Needs a Labour Contractor Licence in Chennai?

Sectors and Typical Contract Workers

SectorTypical contract workers
Manpower and staffing agencies Security guards, housekeeping, office support, drivers, facility staff
Manufacturing units (Ambattur, Guindy, Sriperumbudur) Assembly support, material handlers, maintenance
Construction and infrastructure Civil, electrical, plumbing, fabrication, site support
IT and service establishments Facility management, catering, security
Warehousing, logistics, hospitals, hotels, retail Loading, housekeeping, support staff
← Swipe Left & Right →
Manpower agencies: Having GST, PAN or company incorporation does not satisfy labour licensing. Calling workers "outsourced staff" does not remove labour-law obligations; the actual arrangement matters.

For a 2026 application, verify the number of contract workers, establishment type, nature of work, state or central jurisdiction, whether the contractor works across states, applicable rules and the current Tamil Nadu portal.

Labour Contractor Licence Application Process

1

Identify Your Role

Contractor, principal employer or both.

2

Check Applicability

Worker count, establishment type, nature of work, location, contract duration and inter-state operations.

3

Obtain Principal-Employer Details

Under the earlier Tamil Nadu framework, a Form V certificate from the principal employer was required. Confirm the current form for the framework you are using.

4

Prepare Contract Documents

Work order, contractor agreement, scope of work, worker deployment details, contract duration and maximum worker count.

5

Prepare the Fee and Security Deposit

Under the applicable framework.

6

Submit Online

Through the applicable Labour Department portal, uploading the required documents.

7

Respond to Queries

Clarifications, corrected documents or updated contract details.

8

Receive the Licence

Download it and keep the deployed worker count within its conditions.

The portal workflow may involve account creation, establishment and contractor details, worker details, principal-employer information, document upload, tracking and licence verification. Check the actual workflow before submitting, since the Labour Code transition may change forms and steps.

Documents Required

The list depends on the framework. Under the Tamil Nadu Labour Department's contract-labour procedure:

Document Checklist

DocumentNotes
Registration certificate Establishment / contractor
Principal-employer certificate (Form V) Earlier framework; confirm current equivalent
Contract or agreement Between contractor and principal employer
Security deposit receipt Where applicable
Prescribed fee receipt Where applicable
PAN and Aadhaar / identity proof Applicant
Address proof Applicant
Establishment information Registration certificate, GST where applicable
Worksite or office proof Rental agreement, NOC, ownership or electricity proof
Work order and worker count Maximum workers proposed
← Swipe Left & Right →
Form V

Form V is the certificate issued by the principal employer to support the contractor's licence application under the earlier Tamil Nadu Contract Labour Rules. The Department's application checklist specifically requires it.

2026 point: Because the OSH Code changes the framework, do not assume the old Form V process is the only current route. Confirm the applicable form and portal before filing.

Fees and Cost in Chennai

There is no single amount that applies to every contractor. Cost has two parts.

1. Government / Statutory Cost
Licence fee, registration fee and security deposit.
The amounts depend on the applicable framework and worker count.
The Central OSH Rules, 2026 are reported to set the security deposit at ₹1,000 per contract worker, with specified amounts for very large establishments. Confirm the amounts under the Tamil Nadu rules and portal before paying.
2. Professional Fee

We quote after reviewing the arrangement. The fee is structured by headcount and scope:

What Drives the Fee

ScopeWhat drives the fee
Applicability review only Worker count, roles, number of establishments
Contractor licence application Headcount tier, documentation complexity
Principal employer registration Establishment type, number of establishments
Renewal or transition review Existing licences, framework change
Add-ons: PF, ESI, LWF, payroll Number of workers and states
← Swipe Left & Right →

Inter-state operations, more than one worksite and existing compliance gaps can add scope.

How Long Does It Take?

The Tamil Nadu Labour Department's earlier material states that the licensing officer could pass orders within 60 days under Rule 23. For 2026 applications, the timeline depends on the applicable framework, document completeness, authority scrutiny and any queries. Confirm the current process on the portal.

We prepare the application carefully to reduce avoidable delays, but government approval time cannot be guaranteed.

Licence Validity and Renewal

Earlier Tamil Nadu framework: up to two years, with renewal governed by Rule 29. The Department's procedure refers to applying at least 60 days before expiry.
OSH Code framework: the Ministry of Labour's 2026 handbook states a five-year validity.

Check the framework under which your licence was issued. If you hold an older licence, we review it for transition requirements.

Compliance After the Licence

A contractor may need to manage worker and attendance records, minimum wages and wage payment, working hours and leave, social-security compliance, safety requirements, contract agreements, statutory registers and inspection readiness.

Tamil Nadu's published OSH Code rules state that where contract workers work at the principal employer's premises, the principal employer is responsible for specified health, safety and welfare facilities, while other entitlements remain with the contractor.

PF, ESI, LWF and Professional Tax

A labour contractor licence does not automatically satisfy any of these. Each is assessed separately.

Separate Compliances

ComplianceKey points
PF EPF coverage, UAN, monthly ECR, contributions
ESI Employee registration, contributions, monthly compliance
Labour Welfare Fund Annual employee and employer contributions
Professional Tax Depends on the authority and establishment
← Swipe Left & Right →
Migrant Workers

If contract workers are recruited or employed across state boundaries, additional requirements may apply. The Tamil Nadu Labour Department maintains separate registration for inter-state migrant workers, and the Labour Codes address them too. Tell us before starting if your workers come from another state.

Construction Companies and Factories

Construction sites and factories should assess contract-labour compliance alongside construction- or factory-specific safety and labour requirements. The OSH Code provides electronic licensing routes through the industrial-safety portal, which may involve the Directorate of Industrial Safety and Health depending on the activity.

Contract Labour Agreement

A strong agreement covers scope of work, worker deployment and maximum workforce, wage and PF/ESI responsibility, attendance, leave and working hours, safety and welfare facilities, statutory compliance, worker replacement, termination, insurance, indemnity, record maintenance and inspection cooperation.

The contract should match the actual working arrangement. A clause saying "the contractor is responsible for everything" does not remove the principal employer's statutory responsibilities.

Compliance Checklists

Contractor

Check whether licensing applies and under which framework
Identify worker count and principal employer
Obtain the applicable certificate (Form V or current equivalent)
Prepare contract, work order, identity and establishment documents
Calculate the fee and security deposit
Submit through the current portal and track it
Respond to queries and download the licence
Maintain worker, wage and PF/ESI/LWF records

Principal Employer

Review the contractor's licence or status
Complete the applicable establishment registration
Maintain contractor agreements and track deployed workers
Verify wage and statutory compliance
Review safety and welfare responsibilities
Prepare for inspection

Common Mistakes

Using the old 20-worker rule without checking the current framework
Confusing contractor and principal employer registration
Missing Form V where the earlier framework applies
Ignoring the security deposit
Deploying more workers than the licence permits
Assuming the licence covers PF, ESI or LWF
Treating outsourced workers as outside labour law
Using an outdated application form, or promising a fixed approval time

Inspection and Penalties

Labour authorities may review contract-labour arrangements during inspections. The Tamil Nadu Labour Department lists the Contract Labour Act and Tamil Nadu Rules within its inspection checklist system. Keep the licence or registration, contractor agreements, worker, attendance and wage records, PF/ESI records, payment records, safety and welfare records and statutory registers ready.

Non-compliance can lead to notices, directions, recovery, licence-related action, statutory penalties or prosecution where applicable, and worker-related liabilities. The consequence depends on the legislation, the offence, licence conditions and the notice. Do not rely on generic penalty figures. The safest approach is to correct the underlying issue and respond to any notice promptly.

Example: Ambattur Manpower Agency

Illustrative example, not a client case study.

A manpower agency in Ambattur supplies 75 workers to a manufacturing company. Before deploying them, the agency identifies itself as the contractor, reviews the applicable framework, confirms the principal employer and worker count, prepares the contract and work order, checks the current licensing route, prepares documents and the security deposit, submits through the applicable portal, and coordinates PF, ESI and record-keeping. The principal employer separately verifies its own registration and compliance responsibilities.
